Form 15CA & CB for Foreign Payment

Form 15CA is a declaration form used for furnishing information regarding remittances that are taxable in the hands of the recipient non-resident. It is an online form that needs to be filled and submitted electronically on the Income Tax Department’s website before making the remittance by the person who making payment . The purpose of Form 15CA is to collect information about the nature and purpose of the payment, as well as ensure compliance with tax laws.
Form 15CB is a certification form that is required to be obtained from a Chartered Accountant (CA). The CA examines the relevant documents, verifies the nature of the remittance, and provides a certificate in Form 15CB. This certificate confirms that the remittance is in compliance with the provisions of the Income Tax Act and any applicable tax treaty. The CA certification ensures that appropriate taxes are deducted and the remittance is made in accordance with the tax laws.
Documents Required for Form 15CB
  • Nature of Remittance: Information about the nature of the remittance, such as whether it is a payment for services, royalty, interest, dividend, etc.
  • Tax Residency Certificate (TRC): A Tax Residency Certificate obtained from the recipient non-resident. The TRC is issued by the tax authorities of the recipient’s country of residence and confirms their tax residency status.
  • Agreement or Contract: A copy of the agreement or contract between the remitter and the recipient non-resident, specifying the nature of the transaction, payment terms, and other relevant details.
  • Invoice or Bill: An invoice or bill raised by the recipient non-resident, indicating the amount to be remitted and the purpose of the payment.
PAN (Permanent Account Number): PAN of the remitter and the recipient non-resident.
